Termination notice formula

The single most common fatal defect — a per-year formula that pays less than s.63 at some band, voiding the clause and the cap.

Probationary period

"Six months, no notice" runs past the three-month point where liability under s.63 begins.

Unilateral variation

A discretion clause written so wide it reads as permitting constructive dismissal rather than preventing it.

Absent: illness leave, temporary layoff, working-alone
